AN ORDINANCE ESTABLISHING A PUBLIC SAFETY FACILITY RESTRICTED FUND BALANCE FOR THE PURPOSE OF ACCUMULATING AND RESERVING FUNDS FOR THE PLANNING, DESIGN, CONSTRUCTION, RENOVATION, AND EQUIPPING OF A DEPARTMENT OF PUBLIC SAFETY FACILITY FOR THE CITY OF ERLANGER
WHEREAS
The City of Erlanger is committed to ensuring the safety and protection of its residents through well-equipped and modern public safety facilities; and
WHEREAS
The City anticipates the need for future investment in a Department of Public Safety facility to support police, fire, emergency response, and related operations; and
WHEREAS
The City desires to responsibly plan for such capital investment through the establishment of a dedicated reserve fund that allows the City to accumulate resources over time without reliance on debt financing; and
WHEREAS
Establishing a dedicated capital reserve promotes transparency, fiscal discipline, and long-term financial planning.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF ERLANGER, KENTUCKY:
SECTION 1 – Establishment of Restricted Fund Balance
There is hereby established a restricted capital reserve fund to be known as the Public Safety Facility Restricted Fund Balance.
The purpose of this fund balance shall be to accumulate and reserve financial resources for the planning, design, construction, renovation, expansion, improvement, furnishing, and equipping of a Department of Public Safety facility and associated infrastructure.
SECTION 2 – Permitted Deposits
The Public Safety Facility Restricted Fund Balance may receive deposits from any lawful revenue source of the City, including but not limited to:
- Transfers from the City’s fund balance within the general fund and the capital fund as approved by the City Council.
- Annual budget allocations appropriated by the City Council.
- Federal or state grants related to public safety infrastructure.
- The surplus of funds in the general fund and the capital fund beginning in fiscal year 2026 and concluding once the project is completed, which is anticipated to be completed in fiscal year 2029.
SECTION 3 – Use of Funds
Funds deposited in the Public Safety Facility Restricted Fund Balance shall be used exclusively for costs associated with the planning, design, land acquisition, construction, renovation, expansion, and equipping of a Department of Public Safety facility and related improvements.
Expenditures from the fund balance shall require approval by the City Council in accordance with applicable budgeting and procurement requirements.
SECTION 4 – Fund Administration
The Finance Director of the City of Erlanger shall administer the Public Safety Facility Restricted Fund Balance and shall maintain appropriate accounting records to ensure transparency and compliance with all applicable financial policies and regulations.
SECTION 5 – Budget Integration
The Public Safety Facility Restricted Fund Balance shall be incorporated into the City’s annual budgeting process, and appropriations to or from the fund balance held within the city’s capital fund shall be approved by the City Council as part of the City’s annual budget ordinance or through subsequent budget amendments.
SECTION 5A – Project Funding Plan and Timeline
The City of Erlanger establishes a long-term funding objective for the Department of Public Safety Facility project, with a target total project cost of approximately Eleven Million Dollars ($11,000,000).
The City intends to accumulate funds within the Public Safety Facility Restricted Fund Balance over multiple fiscal years through a combination of anticipated annual surpluses and strategic transfers from the unreserved fund balance, in order to minimize or eliminate the need for debt financing.
The anticipated funding schedule and sources are as follows:

SECTION 6 – Severability
If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be invalid or unconstitutional, such decision shall not affect the remaining portions of this ordinance.
SECTION 7 – Effective Date
This ordinance shall take effect upon passage and publication as required by law.
