02-23-2026 BOA Meeting Minutes – 626 Bluestem / 628 Bluestem / 3392 Woodlyn Hills

Chairman Bob Whelan called the Erlanger Board of Adjustment Meeting to order at 7:00 pm on Monday, February 23, 2026 in the Erlanger Council Chambers.

Board members Bob Whelan, John McVay, Eric Rolf, Terry Farro, and Noah Osterhage were present.

Also present: PDS Senior Planner Patrick Denbow, City Administrator Mark Collier, Director of Economic Development Nick Eads, and City Attorney Jack Gatlin. 

APPROVAL OF MINUTES: M/S, Osterhage-Rolf, that the Minutes of the meeting held on June 23, 2025 be approved as read. All ayes, no nays. Motion carried.   

POSTPONEMENT OF ANY SCHEDULED BUSINESS ITEM: None.

PUBLIC HEARINGS: Chairman Whelan opened the following hearing:

BOA-25-0042: 3392 Woodlyn Hills Drive, applicants Matthew and Christi Dent.

A. REQUEST: (1) A variance request to reduce the rear yard setback in the 

     Residential Compact Subdivision (R-CPS) Zone of the Erlanger Zoning 

     Ordinance; and (2) an appeal of the zoning administrator’s decision regarding 

     the location of pool equipment.

B. SUMMARY: (1) The applicant is proposing to install an in-ground swimming 

     pool in their backyard 18 feet from the rear property line in common with 3474 

     Turkeyfoot Road where 25 feet is required; and (2) the applicant is proposing to 

     relocate the swimming pool equipment to the side yard in common with 3388 

     Woodlyn Hills Drive. The zoning ordinance requires pool equipment to be within 

     a rear yard.

Mr. Whelan confirmed the following:

  • A. PDS made the appropriate notifications per KRS 100.
  • Mr. Farro recused himself from this hearing. There was no other conflict of interest with Board Members.
  • No Board Members visited the site.

Mr. Denbow presented the PDS Staff Report: 

  • Mr. Denbow was given the testimonial oath. 
  • Request to the R-CPS (Residential Compact Subdivision) Zone of the Erlanger Zoning Ordinance to install an in-ground swimming pool in their backyard 18 feet from the rear property line in common with 3474 Turkeyfoot Road where 25 feet is required; and (2) an appeal to relocate the swimming pool equipment to the side yard in common with 3388 Woodlyn Hills Drive.
  • Staff provided a favorable recommendation for the variance of the rear yard setback.
  • Staff recommendation was to uphold the decision of the zoning administrator not to allow pool equipment in the side yard.  
  • Applicants submitted a letter of support signed by the neighboring property owners at 3474 Turkeyfoot Road and 3388 Woodland Hills Drive.

Applicant Matthew Dent addressed the Board:

  • Mr. Dent was given the testimonial oath. 
  • Mr. Dent stated the reasons for wanting to relocate the pool equipment to the side yard.

Mr. Whelan asked if there was a motion for # BOA-25-0042, (1) A variance request to reduce the rear yard setback in the Residential Compact Subdivision (R-CPS) Zone of the Erlanger Zoning Ordinance.

M/S, Rolf-McVay, In favor of the recommendation of the rear yard setback as staff had presented. Mr. Whelan clarified with Mr. Rolf that the variance will not:

1. adversely affect the public health, safety, or welfare,

2. alter the essential character of the general vicinity,

3. will not cause a hazard or nuisance to the public, and

4. will not allow an unreasonable circumvention of the requirements of the zoning regulations.

All ayes, no nays. Motion carried.

Mr. Whelan asked if there was a motion for # BOA-25-0042, (2) an appeal of the zoning administrator’s decision regarding the location of the pool equipment.

M/S, McVay-Rolf, To uphold the decision of the Zoning Administrator to deny the location of pool equipment in the side yard. There was no error in the zoning administrator’s decision to not allow pool equipment to be placed within the side yard. The zoning administrator’s interpretation was based on the literal language of the zoning ordinance, which restricts pool equipment to the rear yard only.  

All ayes, no nays. Motion carried.

BOA-25-0040: 628 Bluestem Drive, applicant Drees Company per Alex Martin. 

A. REQUEST: A variance to reduce the required front yard setback in the R-CVS 

    (Residential Conventional Subdivision) Zone of the Erlanger Zoning Ordinance.

B. SUMMARY: The applicant is proposing to construct a house on an existing flag 

     lot with a front yard setback of 20 feet where 30 feet is required.

Mr. Whelan confirmed the following:

A. PDS made the appropriate notifications per KRS 100.

            B. There were no other conflicts of interest with Board Members.

            C. No Board Members visited the site.

Mr. Denbow presented the PDS Staff Report: 

            A. Mr. Denbow was given the testimonial oath. 

            B. A request in the R-CVS (Residential Conventional Subdivision) Zone to construct a 

                 house on an existing flag lot with a front yard setback of 20 feet where 30 feet is 

                 required.

C. Staff provided a favorable recommendation for this request.

Applicant Alex Martin addressed the Board:

A. Mr. Martin was given the testimonial oath. 

B. Mr. Martin explained the reasons for the variance request.

There were no comments from proponents. 

There were no comments from opponents.

M/S, Whalen-Rolf, A favorable recommendation for the variance to reduce the required front yard setback in the R-CVS (Residential Conventional Subdivision) Zone of the Erlanger Zoning Ordinance.

The variance will not:

1. adversely affect the public health, safety, or welfare,

2. alter the essential character of the general vicinity,

3. will not cause a hazard or nuisance to the public, and

4. will not allow an unreasonable circumvention of the requirements of the zoning regulation.

All ayes, no nays. Motion carried.

A. REQUEST: A variance to decrease the required front yard setback in the 

     R-CVS (Residential Conventional Subdivision) Zone of the Erlanger Zoning 

     Ordinance.

B. SUMMARY: The applicant proposes to construct a home on an existing flag lot 

     with a front yard setback of 10 feet where 30 feet is required.

Mr. Whelan confirmed the following:

A. PDS made the appropriate notifications per KRS 100.

            B. There were no other conflicts of interest with Board Members.

            C. No Board Members visited the site.

Mr. Denbow presented the PDS Staff Report: 

            A. Mr. Denbow was given the testimonial oath. 

            B. A request in the R-CVS (Residential Conventional Subdivision) to construct a home 

                on an existing flag lot with a front yard setback of 10 feet where 30 feet is required.

1. adversely affect the public health, safety, or welfare,

2. alter the essential character of the general vicinity,

3. will not cause a hazard or nuisance to the public, and

4. will not allow an unreasonable circumvention of the requirements of the zoning regulation.

Mr.  Whelan clarified with Mr. Rolf that he was making a favorable recommendation as stated by staff.

All ayes, no nays. Motion carried.

BOARD ITEMS: Election of Chairman and Vice Chairman.
