A MUNICIPAL ORDER AUTHORIZING THE MAYOR TO EXECUTE AN EASEMENT AGREEMENT AND RELATED MEMORANDUM OF UNDERSTANDING WITH T-MOBILE CENTRAL LLC
WHEREAS, the City of Erlanger (“City”) owns certain real property in Erlanger, Kenton County, Kentucky; and
WHEREAS, T-Mobile Central LLC (“T-Mobile”) desires an easement over a portion of the City’s property for ingress and egress and related utility purposes associated with its adjacent cell tower property; and
WHEREAS, the City and T-Mobile have negotiated an Easement Agreement establishing the terms and conditions of the easement, including compensation to the City, maintenance, insurance, indemnification, removal, and other obligations; and
WHEREAS, the City and T-Mobile have also negotiated a Memorandum of Understanding addressing additional site maintenance and improvement obligations, including vegetation removal and replacement of the privacy fence surrounding the cell tower site; and
WHEREAS, the City Council finds that entering into the Easement Agreement and Memorandum of Understanding is in the best interest of the City.
NOW, THEREFORE, BE IT ORDERED BY THE CITY COUNCIL OF THE CITY OF ERLANGER, KENTUCKY, AS FOLLOWS:
- Authorization. The Mayor is hereby authorized and directed to execute, on behalf of the City, the Easement Agreement with T-Mobile Central LLC, substantially in the form presented to the City Council, together with the related Memorandum of Understanding.
- Related Documents and Actions. The Mayor and appropriate City officials are authorized to execute such additional documents and take such actions as may be reasonably necessary to carry out the terms of the Easement Agreement and Memorandum of Understanding.
- Effective Date. This Municipal Order shall take effect upon its adoption.
